Services Overview

Quote Magnet provides exclusive lead generation services for general contractors and home services businesses. Our services include generating and delivering exclusive homeowner leads for various project types including kitchen remodeling, bathroom remodeling, basement finishing, deck building, concrete work, home additions, metal buildings, and other home improvement categories. Lead delivery methods, volume, pricing, and service terms are established in separate service agreements with each client.

Eligibility

By using our services, you represent that you are at least 18 years of age, have the legal authority to enter into these Terms, and are operating a legitimate, licensed contracting or home services business where applicable by law.

Client Accounts and Service Agreements

Access to our lead generation services requires a separate service agreement that specifies your lead types, service areas, pricing, and delivery terms. These Terms of Service apply in addition to any service agreement. In the event of a conflict between these Terms and your service agreement, the service agreement shall control.

Lead Delivery and Exclusivity

Leads provided by Quote Magnet are delivered exclusively to one client per lead. We do not share, resell, or redistribute leads to competing contractors for the same inquiry. While we take reasonable measures to verify lead quality including valid contact information and project intent, we do not guarantee that every lead will result in a booked appointment, signed contract, or completed project. Lead generation involves inherent variability and results depend on factors including but not limited to your response time, sales process, pricing, and market conditions.

Payment Terms

Clients are billed on a per-lead basis or as otherwise specified in their service agreement. Payment is due according to the terms established in your service agreement. We reserve the right to suspend or terminate lead delivery for accounts with outstanding balances. All fees are non-refundable except as specifically provided in your service agreement or our lead replacement policy.

Lead Replacement Policy

If you receive a lead that does not meet our quality standards including invalid contact information, out-of-area inquiries, or duplicate submissions, you may request a replacement lead in accordance with the process outlined in your service agreement. Quote Magnet reviews all replacement requests and makes determinations at its reasonable discretion.

Acceptable Use

You agree not to use our website or services to engage in any unlawful activity, misrepresent your identity or business, interfere with or disrupt our services or systems, attempt to gain unauthorized access to any part of our systems, scrape, harvest, or collect data from our website without permission, or use leads obtained through our services for any purpose other than contacting the homeowner about their requested project.

Intellectual Property

All content, designs, logos, trademarks, text, graphics, and software on our website are the property of Quote Magnet LLC or its licensors and are protected by United States and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on our website without our prior written consent.

Disclaimer of Warranties

Our website and services are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that our website will be uninterrupted, error-free, or free of harmful components. We do not guarantee specific lead volumes, conversion rates, or revenue outcomes.

Limitation of Liability

To the fullest extent permitted by law, Quote Magnet LLC, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services, regardless of the theory of liability. Our total liability for any claim arising out of these Terms shall not exceed the total amount you paid to Quote Magnet in the twelve months preceding the claim.

Indemnification

You agree to indemnify, defend, and hold harmless Quote Magnet LLC, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to your use of our services, your violation of these Terms, or your violation of any applicable law or regulation.

Termination

We may suspend or terminate your access to our services at any time for any reason, including violation of these Terms. You may terminate your service agreement in accordance with its terms. Upon termination, your right to use our services ceases immediately, but provisions that by their nature should survive termination will remain in effect.

Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Pinellas County, Florida.

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of our website or services after any changes constitutes your acceptance of the updated Terms.
